Well, by the time the sleazy lawyers start talking, the victim was at fault, plus he hated animals. The two LSU fans will be the salt-of-th-earth, non-violent, defending themselves, and worthy of sainthood.

It looks like the charges from the onset are light, and they'll probably get pleaded down.  If two people beat one man unconscious (particularly if they beat on him after he was unconscious), it looks like a there would be a charge a little stiffer than manslaughter for at least the initial charge.  If someone threw a punch and some freak accident happened where he hit his head on something falling down, then maybe not.  But since two men were involved, it sounds like a more malicious event than that.

If there is no murder charge, then likely there is no evidence that they intended to kill him or cause great bodily harm (no specific intent).  We don't know how he died.

Quote
§31. Manslaughter

A. Manslaughter is:

(1) A homicide which would be murder under either Article 30 (first degree murder) or Article 30.1 (second degree murder), but the offense is committed in sudden passion or heat of blood immediately caused by provocation sufficient to deprive an average person of his self-control and cool reflection....; or

(2) A homicide committed, without any intent to cause death or great bodily harm....

B. Whoever commits manslaughter shall be imprisoned at hard labor for not more than forty years.
LA Rev Stat § 14:31

I'll defer to your expertise on the the legal matter.  Don't get me wrong, I'm not for overzealous DAs looking for political gain vs. doing what's best.  If it's what the law calls for given the details (which we don't know), then I'm in full agreement.

I'm by no means a criminal law expert -- in my limited experience, DAs do exactly what you suggest, overcharge and then plead down.  But that might be different in a small town.  And there have to be facts supporting the charge.
